Acceptable Use Policy
Version 1.0 · Last updated:
This Acceptable Use Policy (the "AUP") sets out what may not be done with the Service. It applies to every Customer, User, and End User, forms part of the Terms of Service (it is the detail behind Section 13), and is enforced under Sections 32 and 33. Where this AUP and the Terms differ, the Terms govern.
Prohibited use of the Service
The Service may not be used to:
- break the law or facilitate unlawful activity, or infringe the rights of any person;
- send spam, unsolicited bulk messages, or content that is deceptive or misleading;
- upload or transmit content that is unlawful, defamatory, obscene, or hateful, or that infringes intellectual property, privacy, or other rights;
- collect or process special categories of personal data through the widget, or the personal data of children, without a lawful basis and the notices and consents the law requires;
- present the AI assistant as a human, remove or alter the AI-interaction disclosure designed into the widget (Section 5), or hold the output out as professional legal, medical, financial, or safety-critical advice given by a qualified person;
- misrepresent the Service, or impersonate another person or business.
Security and integrity
No person may:
- probe, scan, or test the vulnerability of the Service, or breach or circumvent its authentication or security controls, except with Ethere's prior written authorisation;
- interfere with, overload, or disrupt the Service or the infrastructure of others, or circumvent the usage limits in Section 14 or the cost bounds of the widget;
- scrape, harvest, or extract data from the Service other than through the interfaces Ethere provides;
- reverse engineer or attempt to derive the source code of the Service, except to the extent that restriction is prohibited by law;
- resell, sublicense, or lease access to the Service, or use it to build or train a competing product.
Customer responsibility
The Customer is responsible for its Users' and its End Users' use of the Service, for the content it uploads or makes available through the widget, and for the notices and consents its End Users are entitled to (Section 16). The Customer must not configure the Service to produce content that this AUP prohibits.
Enforcement
Ethere may investigate a suspected breach of this AUP. Where a breach is confirmed or reasonably suspected, Ethere may remove or disable the offending content, throttle usage, or suspend or terminate access under Sections 32 and 33, and may report unlawful activity to the competent authorities. Where Ethere removes or disables content, it will give the affected user a clear and specific statement of reasons as required by Article 17 of the Digital Services Act (Section 50).
Reporting abuse or a vulnerability
Report abuse of the Service, or content that breaches this AUP, to abuse@ethere.cloud. Report a suspected security vulnerability to security@ethere.cloud, the address published in security.txt. A report should state what was observed, where, and when. Ethere acknowledges reports and investigates them.
Relationship to the Terms
This AUP does not limit any right Ethere has under the Terms. Repeated or serious breaches may lead to termination under Section 32. Ethere may update this AUP as the Service evolves; the current version is always published on this page.
